Kahnawà:ke Gaming Commission

The regulator of the Kahnawà:ke Mohawk Territory, which has licensed online gaming since 1999. Its permit holders are hosted in Kahnawà:ke and the Regulations govern gaming offered from there, not where the player lives.

What this licence promises

What the licence is
The Kahnawà:ke Gaming Commission licenses interactive gaming under its own Regulations concerning Interactive Gaming, made under section 35 of the Kahnawà:ke Gaming Law. Operators that want to offer games to players hold a Client Provider Authorization and must be hosted in Kahnawà:ke.

How to check a licence
The Commission publishes a list of certified operators and URLs. That list is marked "Updated September 28, 2023" on the page we opened, so a site missing from it is not proof of anything, and a site on it may have changed. The Commission says its logo is linked to a Logo Certification Program that lets players verify a site is licensed.

Where it applies
The Regulations govern gaming "based in or offered from within" Kahnawà:ke, not where players live. Operators themselves must follow the laws of comparable jurisdictions, and the Commission warns that not all listed URLs are accessible in all jurisdictions.

Identity checks
Customer due diligence starts when an account is opened; identity must be verified from reliable independent documents, as soon as reasonably practicable after the first deposit, before any payment to the customer and within 30 days. The minimum age is 18, or the higher age set by the player's own country. No amount threshold was found in the texts checked.

Player protection
A registered player can set a daily, weekly or monthly deposit limit by written notice (including zero). A player can also ask the Commission for permanent self-exclusion from all licensed sites.

Complaints go to the operator first, then to the Commission ([email protected] or its form), within six months of the issue first arising.

The Regulations require the operator's liability for player balances to be separately identifiable and player balances to be covered by liquid funds at all times. The texts we checked do not describe a trust, segregated account or insolvency ring-fence.

    The Commission made its Regulations concerning Interactive Gaming on 8 July 1999, under section 35 of the Gaming Law, and says it has licensed and regulated interactive gaming sites continuously since.
